These Terms of Service (the “Terms”) govern your access to and use of ShareBuggy, a software platform operated by ShareBuggy, LLC (“ShareBuggy,” “we,” “us,” “our”). ShareBuggy helps families coordinate in-home childcare with the people who provide it.
By creating an account, accepting an invitation to join a Family Workspace, or otherwise using ShareBuggy, you agree to these Terms. If you do not agree, do not use the Service.
Please read Section 3 carefully. It explains what ShareBuggy is and, just as importantly, what it is not. ShareBuggy is software. We do not employ caregivers, place caregivers, vet caregivers, or participate in the care relationship in any way.
1. Who May Use ShareBuggy
1.1 Age requirement
You must be at least 18 years old to create a ShareBuggy account. ShareBuggy is a service for adults. It is not directed to children, and children may not create accounts or use the Service.
1.2 Children are not users
ShareBuggy is used by adults to coordinate the care of children. Children do not have accounts, do not log in, and do not provide information to us directly. Information about a child is entered by the adults responsible for that child. This distinction matters, and it is described in more detail in our Privacy Policy.
1.3 Authority to provide information about a child
If you add a child to a Family Workspace, you represent that you are that child’s parent or legal guardian, or that you have been authorized by a parent or legal guardian to do so. You are responsible for the accuracy of that information and for having the right to provide it.
2. Accounts, Workspaces, and Roles
2.1 Family Workspace
The core unit of ShareBuggy is a Family Workspace — a private space belonging to one family. Each Workspace has one or more Family Administrators and may include Caregivers invited by a Family Administrator.
2.2 Family Administrator
A Family Administrator is a parent or legal guardian who owns and controls a Family Workspace. Family Administrators can:
- Add and remove children from the Workspace;
- Invite Caregivers and revoke their access at any time, for any reason, without notice;
- View all content in the Workspace, including all content contributed by Caregivers;
- Export or delete Workspace content;
- Manage billing and cancel the subscription.
2.3 Caregiver
A Caregiver is an adult invited into a Family Workspace by a Family Administrator — a nanny, a family member, a babysitter, or anyone else providing care. Caregivers can view and contribute to the Workspace they have been invited to, within the permissions set by the Family Administrator.
Caregivers should understand: access to a Family Workspace is granted by the family and can be revoked by the family at any time. Your access is not permanent and is not something ShareBuggy can restore on your behalf if a family removes you.
2.4 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at legal@sharebuggy.co if you believe your account has been compromised. Do not share your account with anyone — including another caregiver covering your shift. Each person needs their own account.
3. What ShareBuggy Is — and What It Is Not
3.1 We provide software, not childcare
ShareBuggy is a coordination tool. We provide software that helps families and caregivers organize schedules, record daily activities, share photos and updates, and communicate. We do not provide childcare, supervision, or any care service of any kind.
3.2 We are not a party to the care relationship
The relationship between a family and a caregiver is entirely between them. ShareBuggy is not an employer, joint employer, agent, staffing agency, or intermediary. Specifically, we do not:
- Employ, engage, or contract with caregivers;
- Screen, vet, interview, verify, or run background checks on any user;
- Verify credentials, certifications, references, work authorization, or identity;
- Set, negotiate, or influence wages, hours, duties, or terms of employment;
- Process wage payments between families and caregivers;
- Supervise, direct, or control the work any caregiver performs;
- Introduce, match, refer, or recommend caregivers to families, or families to caregivers.
3.3 No placement or matching service
ShareBuggy does not currently offer any caregiver placement, matching, introduction, or referral service. The Service described in these Terms is limited to coordination software used by families and caregivers who already have a relationship with each other. If ShareBuggy offers any placement, matching, or introduction service in the future, that service will be governed by a separate agreement that you would need to review and accept separately. Nothing in these Terms grants you access to, or governs, any such future service.
3.4 You are responsible for your employment obligations
If you employ a caregiver in your home, you may have obligations under federal, state, and local law — including wage and hour laws, overtime, minimum wage, payroll tax withholding, workers’ compensation insurance, paid sick leave, and written contract requirements that apply to household employees in some jurisdictions. These obligations are yours, not ours.
ShareBuggy does not provide legal, tax, employment, or accounting advice. Records you keep in ShareBuggy — including schedules, hours, or logs — are for your own coordination purposes. They are not designed to satisfy any legal recordkeeping requirement, and you should not rely on them for that purpose. Consult a qualified professional.
3.5 No emergency or medical service
ShareBuggy is not an emergency service and must never be used as one. Do not use ShareBuggy to report an emergency, request urgent assistance, or communicate time-critical medical information. If a child is injured, ill, or in danger, call 911 or your local emergency number and contact the family directly by phone.
Messages, notifications, and posts in ShareBuggy may be delayed, undelivered, or not seen. Push notifications depend on device settings, network conditions, and third-party services outside our control. Never assume a message has been received because it was sent.
Any allergy, medication, dietary, or medical information stored in ShareBuggy is entered by users and is not verified by us. It is a convenience reference, not a medical record. Confirm critical health information directly and in person.
4. Content and Ownership
4.1 Your content
“User Content” means anything submitted to ShareBuggy: photos, videos, text, activity logs, schedules, notes, messages, documents, and child profile information.
4.2 Family ownership of Workspace Content
As between the family and the caregiver, the Family Administrator’s family owns all content in the Family Workspace — including content contributed by a Caregiver. This includes photos and videos of the family’s children taken by a Caregiver in the course of providing care.
If you are a Caregiver, this means:when you post a photo, video, log entry, or message to a Family Workspace, you assign to that family all rights you may have in it, to the fullest extent permitted by law, and you grant that family an unrestricted license to use it. You may not download, copy, retain, republish, share, or use content depicting a family’s child outside the Service, and you may not retain copies after your access ends.
4.3 License to ShareBuggy
You grant ShareBuggy a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, adapt, and display User Content solely for the purpose of operating, securing, maintaining, and improving the Service for you. This license ends when the content is deleted, except for backups pending routine deletion.
We will not use photos or videos of children for marketing, advertising, promotion, or public display. We will not sell User Content. We will not use User Content to train machine learning or artificial intelligence models. We will not share User Content with third parties except as described in the Privacy Policy.
4.4 Your responsibility for content
You represent that you have all rights necessary to submit the content you submit, and that it does not violate any law or any other person’s rights. If you photograph or record a child who is not in your care — for example, another child at a playground or a playdate — you are responsible for having the consent of that child’s parent or guardian before posting it.
5. Acceptable Use
You agree not to:
- Use ShareBuggy for any unlawful purpose, or to facilitate any unlawful act;
- Post content that is sexually explicit, abusive, harassing, threatening, hateful, or that sexualizes or exploits a child in any way;
- Photograph, record, or post images of any child without the authority to do so;
- Use ShareBuggy to surveil, monitor, or track another adult without their knowledge, or in a manner that violates applicable recording, wiretapping, or privacy laws;
- Access a Family Workspace you have not been invited to, or attempt to circumvent access controls;
- Retain, export, or redistribute another family’s content after your access has ended;
- Impersonate any person, or misrepresent your identity, relationship to a child, or qualifications;
- Scrape, crawl, reverse engineer, decompile, or attempt to derive the source code of the Service;
- Interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
- Resell, sublicense, or provide the Service to third parties as a commercial service.
5.1 Reporting and enforcement
Report violations to legal@sharebuggy.co. We may investigate, remove content, and suspend or terminate accounts that violate these Terms. We may act immediately and without notice where a child’s safety may be at risk.
Child safety.We report suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) as required by law, and we cooperate with law enforcement. We may preserve and disclose content where we believe in good faith it is necessary to prevent harm to a child.
6. Privacy
Our Privacy Policy explains what information we collect, how we use it, how long we keep it, and the choices you have. It forms part of these Terms. Because ShareBuggy involves information about children, we encourage you to read it in full.
7. Subscriptions, Billing, and Cancellation
7.1 Paid plans
Some features require a paid subscription. Current pricing is shown at signup and on our pricing page. Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and renew automatically until cancelled.
7.2 Who pays
Subscriptions are purchased by families, not caregivers. Caregivers are never charged for access to a Family Workspace they have been invited to.
7.3 Payment processing
Payments are processed by Stripe. We do not store full payment card numbers. Your use of Stripe is subject to Stripe’s terms and privacy policy.
7.4 Cancellation
You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. You retain access until then.
7.5 Refunds
Except where required by law, fees are non-refundable and we do not provide partial-period refunds. If you believe you have been charged in error, contact support@sharebuggy.co within 30 days and we will review it in good faith.
7.6 Price changes
We may change pricing. We will give you at least 30 days’ notice by email before a change affects your subscription. If you do not agree, you may cancel before the change takes effect.
7.7 Failed payment
If a payment fails, we may retry and will notify you. If payment is not resolved, we may suspend paid features. Your data is retained during suspension in accordance with Section 9.
8. Ending Access
8.1 A family removing a caregiver
A Family Administrator may remove a Caregiver at any time. On removal:
- The Caregiver immediately loses all access to that Family Workspace and its content;
- Content the Caregiver contributed remains in the family’s Workspace and remains the family’s content;
- The Caregiver’s own account and personal profile are unaffected and remain theirs;
- The Caregiver may not retain or use any copies of the family’s content.
8.2 A caregiver leaving
A Caregiver may leave a Family Workspace at any time, with the same effects described above. A Caregiver may delete their own ShareBuggy account entirely; this removes their personal profile but does not remove their contributions from families’ Workspaces, which belong to those families.
8.3 Termination by us
We may suspend or terminate any account that violates these Terms, creates risk or legal exposure, or is used in a way that may endanger a child. Where practical we will give notice; where a child’s safety may be at risk, we will not.
8.4 Discontinuing the Service
If we discontinue ShareBuggy, we will give at least 60 days’ notice and provide a means to export your content before it is deleted.
9. Data Retention and Deletion
When a Family Workspace is cancelled or deleted:
- 30 days: full access is retained so you can export your content.
- Days 31–120: content is retained in restricted storage and can be restored on request.
- After 120 days: content is permanently deleted, including from routine backups on their normal cycle.
You may request immediate permanent deletion at any time by contacting privacy@sharebuggy.co. We may retain limited records where required by law — for example, transaction records for tax purposes, or content preserved under legal process.
10. Third-Party Services
ShareBuggy depends on third-party providers for hosting, storage, payments, notifications, and email. Their failure, downtime, or delay may affect the Service. We are not responsible for third-party services, and your use of them may be subject to their own terms.
11. Intellectual Property
ShareBuggy, including its software, design, branding, logos, and content we create, is owned by ShareBuggy, LLC and protected by intellectual property law. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You get no other rights.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that messages or notifications will be delivered; or that any content will be accurate.
WE MAKE NO REPRESENTATION OR WARRANTY REGARDING ANY USER. We do not vet, screen, or verify caregivers or families. We make no representation as to any person’s identity, background, qualifications, trustworthiness, or fitness to care for a child. Evaluating a caregiver is entirely your responsibility, and we strongly encourage independent reference checks and background screening.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAREBUGGY, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CONTENT, ARISING FROM OR RELATING TO THE SERVICE.
WE ARE NOT LIABLE FOR ANY ACT OR OMISSION OF ANY USER, including any conduct of a caregiver toward a child, any injury to a child, any employment dispute, or any harm arising from the care relationship. That relationship is between the family and the caregiver.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law.
14. Indemnification
You will indemnify, defend, and hold harmless ShareBuggy, LLC and its officers, directors, employees, and agents from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, your violation of these Terms or any law, or any dispute between you and another user — including any dispute arising from a care or employment relationship.
15. Disputes
15.1 Talk to us first
Before filing any formal claim, contact us at legal@sharebuggy.co and give us 30 days to resolve it. Most problems can be solved without lawyers.
15.2 Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
16. Changes to These Terms
We may update these Terms. For material changes we will give at least 30 days’ notice by email and in the app before they take effect. Continued use after the effective date means you accept the updated Terms. If you do not accept, stop using the Service and cancel your subscription.
New services require new agreement. If we launch a materially different service — including any caregiver placement, matching, introduction, or referral service — it will be governed by a separate agreement presented to you at that time. These Terms will not be silently expanded to cover it.
17. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Survival.Sections 3, 4, 9, and 11–17 survive termination.
